Standard Warranty Agreement
This Standard Warranty Agreement (“Agreement”) is issued by TruCraft Contracting & Service Company (“Company”) to the residential or commercial customer (“Customer”) receiving plumbing services (“Work”).
Warranty Coverage
TruCraft Contracting & Service Company ("Company") warrants that all plumbing services, including installation, repair, and maintenance (collectively referred to as "Work"), performed for residential or commercial customers ("Customer") shall be free from defects in workmanship and materials when executed in accordance with industry standards. This warranty applies only to the specific Work performed and does not extend to the entire plumbing system or unrelated components. This warranty commences on the date the Work is completed and accepted by the Customer.
Duration of Warranty
Unless otherwise stated in writing, the warranty period ("Warranty Period") for the Work performed is one (1) year from the date of completion.
It is expressly understood that drain snaking services are not included within the scope of this warranty. Drain snaking, if performed, is provided on a non-warranty basis and is not eligible for any warranty claims under this Agreement unless otherwise agreed upon in writing.
Any alterations to the Warranty Period must be expressly documented in the service agreement between the Company and the Customer.
Warranty Terms
During the Warranty Period, if defects arising directly from the Company’s workmanship or materials occur, the Company will, at its sole discretion:
-
Repair: Correct the defective Work; or
-
Replace: Provide replacement parts or redo the Work as necessary.
This warranty applies exclusively to the original installation or service provided and is non-transferable.
Exclusions and Limitations
This warranty does not extend to:
Acts of Nature:
Damage or defects resulting from natural disasters, acts of God, or other external causes beyond the Company’s control.
Misuse or Neglect:
Damage from improper use, maintenance, neglect, or misuse, including modifications or repairs performed by anyone other than the Company.
Normal Wear and Tear:
Deterioration or defects stemming from normal aging, regular use, or environmental conditions.
Pre-existing Conditions:
Issues not arising as a direct result of the Work performed by the Company, including failures caused by existing weaknesses in the plumbing system.
Consequential Damage from Existing Conditions:
The Company is not responsible for damages that occur as a result of pre-existing issues, deteriorated piping, corroded components, or failures in unrelated parts of the plumbing system that may surface during or after the Work.
Manufacturer’s Defects:
Defects attributable solely to the design or manufacturing processes of third-party products or components. Where a manufacturer’s warranty applies, remedies must be pursued through the manufacturer.
Customer-Supplied Materials:
No warranty is provided for parts, fixtures, or materials supplied by the Customer. Any failure, defect, or incompatibility arising from customer-provided materials is excluded from this warranty.
Tampered Repairs:
Any repairs or modifications that have been altered or tampered with by parties other than the Company.
Clogs or Back-ups:
Clogs, back-ups, or blockages resulting from improperly disposed items or foreign materials introduced into the plumbing system.
Non-Payment:
All warranties under this Agreement are void if payment for the Work is not tendered when due.
Non-Transferability:
This warranty is issued solely to the Customer on record at the time of service and shall not be transferable to any subsequent owner or party.
Limitation of Liability:
The Company’s liability is limited solely to the remediation of the defective Work and explicitly excludes any incidental or consequential damages, including but not limited to property damage, loss of profits, or other economic losses.
Customer Obligations
Notification:
The Customer agrees to notify the Company in writing within thirty (30) days of discovering any defect covered under this warranty.
Access:
The Customer shall provide reasonable access to the site for inspection and performance of any warranted services. Delays in access or scheduling caused by the Customer do not extend the Warranty Period. Failure to meet these obligations may void the warranty with respect to any subsequent claim.
Dispute Resolution and Governing Law
Governing Law:
This Warranty Agreement shall be governed by and construed in accordance with the laws of the State of Maryland.
Dispute Resolution:
Any disputes arising from or related to this warranty shall first be attempted to resolve by mutual negotiation between the parties. If unresolved, the dispute shall be submitted to binding arbitration under the rules of an agreed-upon arbitration service (e.g., the American Arbitration Association) with the location of arbitration in Maryland. The arbitrator’s award shall be final and binding and may be confirmed in any court of competent jurisdiction.
Entire Agreement
This document constitutes the entire agreement regarding the warranty for services rendered by TruCraft Contracting & Service Company. It supersedes all prior or contemporaneous understandings, communications, or agreements, whether oral or written. Any modifications or amendments to this Agreement must be executed in writing and signed by an authorized representative of the Company.
Limitation of Implied Warranties
To the fullest extent permitted by law, TruCraft Contracting & Service Company disclaims all implied warranties, including any warranties of merchantability or fitness for a particular purpose, except as expressly provided in this Agreement.
